Terms & Conditions

The use of Wright’s Homestead website or social media sites (known as ‘Site’ throughout the remainder of this document) and existing under the laws of the State of New York, Wright’s Homestead is governed by the policies, terms and conditions set forth in this document. Please read them carefully. Your use of, and orders placed on this Site signifies your acceptance of the Terms & Conditions. Click here to read and accept the Terms & Conditions.

Terms & Conditions

  • Privacy & Security Disclosure

The Wright’s Homestead Privacy Policy may e viewed at ____________________ (YPC to insert).  Wright’s Homestead reserves the right to modity its Privacy Policy in its reasonable discretion from time to time.

  • Payment Methods

 We accept US issued credit/debit cards. Our website uses 128 bit Secure Socket Layer encrypted connection. YPC to confirm, or, add language describing security used on website.

  • Shipping Policies

Company ships all orders, both within the 50 United State and Internationally. Depending on product availability, orders are packaged usually within 1-3 business days. You will receive an e-mail notification if an item(s) is out of stock, with an estimated shipping date.

Accurate shipping address and mobile phone number (to text if necessary) are required. Your signature is not normally required for delivery, unless specifically requested by you in our “Special Delivery” text box on our order page.  Additional fees may be incurred for this request.

It is your responsibility to track your package. If your tracking information show that your package has been delivered and you have not received it, please contact the shipping provider first. If they cannot locate the package, please contact us. You must contact us within 3 days of your package being marked delivered for any refund. If package is returned to us because of incorrect address and package is undeliverable, you will have to pay for shipping costs to be reshipped. If you would like to cancel the order and receive a refund on your order after it is deemed undeliverable, you will be charged a $10 handling fee; plus, our shipping costs. Handling fee and shipping will be deducted before balance is returned. Sorry to have to do this, but it was not our mistake and we have time, labor and financial resources invested in this package and we should not have to incur a financial loss.

  • Delivery Confirmation

Because many instances may occur at your delivery address that is beyond our control, you agee that any delivery confirmation provided by the carrier is deemed sufficient proff of delivery to the card holder, even without a signature.

  • Return & Cancellation Policy

If you are dissatisfied with our product, you may return the unused portion for a store credit.  To receive a store credit, your return must be approved and postmarked 7 days from the delivery date provided by the carrier. 

Products may not be returned for scent preference. If you are unsure of a scent, please try the smallest size available in a new scent first.

The following terms apply for all returned items: 

Contact Wright’s Homestead at Admin@WrightsHomestead.com or click here. The subject line should read “RMA” (which means Return Material Authorization”). The email should include the reason for the return request and if you would like to exchange it for another item.  If so, specify replacement item. You will receive a response within 3 business day with an RMA#, if you are approved for a store credit/exchange. 

When approved for a store credit/exchange, return the item(s) to:

Shipping charges and return shipping charges are non-refundable in any case. Wright’s Homestead is not responsible for lost or stolen items.  We recommend all returned items to be sent using some type of delivery confirmation system to ensure proper delivery.

After the shipping department receives your return, we will issue your store credit/exchange within 3-5 business days. You will be notified when your return has been processed, or if additional time is required for a longer turn-around time (out of stock items for exchanges, etc). 

Any undamaged items returned must qualify to be in restockable condition to receive store credit/exchange. 

Damages & Claims

Wright’s Homestead goes to great lengths to pack each order with accuracy and care. Occasionally, during shipment, accidents happen and products break. Please take photos of the damage (exterior of shipping box, interior of box with damaged item(s) and the damaged item(s) themselves to send to us at Admin@WrightsHomestead.com or click here. The subject line should read “Damaged Item(s)”. Please contact us within 5 days from the delivery date provided by the carrier. You will receive an RMA# to returns the damaged items and be postmarked 7 days from receipt of an RMA#.

Wright’s Homestead is not responsible for lost or stolen items.  We recommend all returned items to be sent using some type of delivery confirmation system to ensure proper delivery.

After the shipping department receives your return, we will exchange the items within 3-5 business days. You will be notified when your return has been processed, or if additional time is required for a longer turn-around time (out of stock items for exchanges, etc). 

Goods damaged by opening boxes with box cutters or other types of dames caused by recipient will not be returnable.

  • Chargeback Policy

All references to a “chargeback” refer to a reversal of a credit/debit card charge place on our Site(s). There is no reason t=for a chargeback to ever be filed.  If a credit is due, simply contact us at Admin@WrightsHomestead.com or click here. Unnecessary chargebacks are theft and can be prosecuted. If you feel that your credit/debit card was used fraudulently on our Site(s), please conact us for immediate eresolution.  You agree that you will not chargeback any amunts charged to your credit/debit card on this site. F you chargeback a credit/debit card charge for a payment initiated by you, you agree that this site may recover the amount of the chargeback in addition to $20 by any means deemed necessary, including but not limited to recharging your credit/debit card or having the amount recovered by a collection agency.

  • Back Orders

You will be notified of any items currently out of stock and an expected delivery date within 48 hours of receipt of order. Your account will not be charged until the item is shipped.

  • Third Party Interactions

During use of our Site(s), you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of, advertisers or sponsors showing their goods and/or services through the Site(s). Any such activity, and any term, conditions, warranties or representations associated with such activity, is solely between you and the applicable third-party. Wright’s Homestead shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third-party. Wright’s Homestead does not endorse any sites on the internet that are linked through its Site(s). Wright’s Homestead provides these links to you only as a matter of convenience, and in no event shall Wright’s Homestead be responsible for any content, products or other materials on or available from such sites. Wright’s Homestead provides products to you pursuant to the terms and conditions of this Agreement. You recognize, however, that certain third-party providers of ancillary software, hardware or services may require your agreement to additional different license or other terms prior to your use of, or access to, such software, hardware or services.

 

  • Ordering Disclaimer

Your electronic order confirmation, or ay form of confirmation, does not signify our acceptance of your order. Wright’s Homestead reserves the right to accept or deny shipment to anyone for any reason.  Wright’s Homestead reserves the right to require additional information before processing any order. If an order appears fraudulent in any way, Wright’s Homestead reserves the right to cancel the order, notify the card holder and the proper authorities.

 

  • Product Disclaimers; Disclaimers of Warranty

Wright’s Homestead makes no representation, warranty or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of any information on their Site(s). Wright’s Homestead does not represent or warrant that (a) the use of the Site(s) will be secure, timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data; (b) the Site(s) or its products will meet your requirements or expectations; (c) any stored data will be accurate or reliable; (d) the quality of any products, services, information or other material purchased or obtained by you through the service will meet your requirements or expectations; (e) errors or defects will be corrected; or, (f) the service or the server(s) that make the service available are free of viruses or other harmful components, the service and all content is provided to you strictly on an “as is” basis.  All conditions, representations and warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose, or non-infringement of Third Party rights, are hereby disclaimed to the maximum extent permitted by applicable law by Wright’s Homestead. 

  • Limitation of Liability

 In no event shall either party’s aggregate liability exceed the amounts actually paid by and/or due from you in the six (6) month period immediately preceding the event giving rise to such claim, in no event shall either party be liable to anyone for any indirect punitive, special, exemplary, incidental, consequential or other damages of any type or kind (including loss of data, revenue, profits, use or other economic advantage) arising out of, or in any way connected with this Site, including, but not limited to, the use or inability to use the Site, or for any content obtained from or through the Site, any interruption, inaccuracy, error or omission, regardless of cause in any information contained herin, even if the party from which damages are being sought have been previously advised of the possibility of such damages. Certain states and/or jurisdictions do not allow the exclusion of implied warranties or limitations of liability for incidental, consequential or certain other types of damages, so the exclusions set forth above may not apply to you.

  • Notice

Wright’s Homestead may give notice by means of a general notice on the Site’s electronic mail to your e-mail address on record in Wright’s Homestead account information, or by written communication sent by first class mail or pre-paid post to your address on record in Wright’s Homestead account information.  Such notice shall be deemed to have been given upon the expiration of 48 hours after mailing or posting (if sent by first class mail or pre-paid post) or 48 hours after sending (if sent by e-mail). You may give notice to Wright’s Homestead (such notice shall be deemed given when received by Wright’s Homestead) at any time by any of the following: letter delivered by nationally recognized overnight delivery service or first class postage prepaid mail to Wright’s Homestead at the following address: Western NY, in either case, addressed to the attention of Darrell or Sharon Wright.

  • Modification to Terms

Wright’s Homestead reserves the right to modify the Terms and Conditions of this Agreement or its policies relating to its products and services at any time, effective upon posting of an updated version of this Agreement on their Site(s). You are responsible for regularly reviewing this Agreement. Continued use of the Service after any such changes shall constitute your consent to such changes. 

  • General

With respect to United States Customers, this Agreement shall be governed by New York law and controlling United States federal law, without regard to the choice or conflicts of law provisions of any jurisdiction, and any disputes, actions, claims or causes of action arising out of or in connection with this Agreement or the Service shall be subject to the exclusive jurisdiction of the state courts located in Niagara County, New York or the federal court located in Erie County, New York.  If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provisions(s) shall be construed, as nearly as possible, to reflect the intentions of the invalid or unenforceable provision(s), with all other provisions remaining in full force and effct. No joint venture, partnership, employment, or agency relationship exists between you and Wright’s Homestead as a result of this agreement or use of the Site(s). The failure of Wright’s Homestead to enforce any right or provision in this Agreement shall not constitute a waiver or such right or provision unless acknowledged and agreed to by Wright’s Homestead in writing. This Agreement, together with any applicable form and policies, comprises the entire agreement between you and Wright’s Homestead and supersedes all prior or contemporaneous negotiations, discussions or agreements, whether written or oral, between the parties regarding the subject matter contained herein.
